On behalf of Council Member Tower and myself, we invite you to participate as a stakeholder and provide your feedback on this issue. City Council is soliciting input regarding the proposed amendments to the City of Virginia Beach’s noise ordinance through a survey that is now available online.


The survey can be accessed here https://publicinput.com/noiseordinance. If you do not have access to a computer or are otherwise unable to complete the online survey, please utilize the copy attached to the email to make your changes. The document can be returned to Nancy Bloom, 2401 Courthouse Dr., Suite 3054, Virginia Beach, VA 23456.


Please note that while comments are appreciated, the survey is requesting residents and stakeholders provide their suggested textual changes to the proposed amendments. There are two options available to participate in the online survey:

  1. Download the Word version of the proposed noise ordinance. Turn on the “Track Changes” option. Make your proposed changes. Save your document using your last name and “proposed changes.” For example: Smith-Proposed Changes. Upload the document as described in the first tab on the front page of the survey.
  2. For those not familiar with or who would prefer not to use Word’s track change function, the survey has the proposed ordinance separated into sections, each with its own comment box. If you have proposed changes within a section, please use the comment box to indicate the line number and your proposed text change. Once you have finished submitting all your changes, go to the final tab of the survey and click “Submit.”
  3. The survey will remain open until 11:59 p.m. on Friday, September 30. Once closed, the recommended changes will be provided to Council Member Tower and myself for review.
    The City will be scheduling two facilitated listening sessions to review the submitted proposed changes, one occurring in mid-to-late afternoon and one occurring early evening. We would

Finally, enclosed is a clean copy of the proposed ordinance for your reference. The current noise ordinance can be found at http://www.Municode.com (Select Code Library, then Virginia, then Virginia Beach; the relevant section is Chapter 23, Article II (Section 23-63 through Section 23- 73 of the City Code (not the City Charter)).
Rest assured that City Council has expressed as recent as the Tuesday, September 6, 2022, informal session that while a sixty-day timeline was set as forcing function, our peers on City Council have informed Council Member Tower and me to sustain a measure pace, but not to let the sixty-day deadline drive the submission of a proposal we do not believe is ready for public hearing before the full City Council.

“Hello fellow Shore Drive neighbors,

I am requesting the survey linked below be distributed to in order to get more respondents. Below is a post I made on “Next Door Safety” a few days ago and have received 55 individual person responses from communities located along the Bay Beach/Shore Drive. So far the information collected in the survey is revealing. It appears most folks have strict control of their dogs on the beach, however 90% of these same folks have encountered dogs not under control and 70% of the 90% say they have had concerns about the safety of their dog or person. 10% of the 70% have had slight or severe injury done to their dog by uncontrolled dogs.

More survey respondents are necessary for this survey to provide actionable data. Not looking for opinions on what should be done. That will come after this survey data is analyzed, a committee is formed and more research is done. Looking to provide options to the City to make out beaches enjoyable for all. This is not, repeat is not, an effort to have a leash law for the beaches….”

I am a long time resident and a local Realtor that has clients living in the immediate area of Ocean Shore Ave and other condos down there. I also am currently representing a buyer that is concerned about a purchase on Urchin Rd because of the Westminster expansion. There are many concerns about personal property being devalued (city assessments are already dropping in the immediate area). I am also seriously concerned that because of the money and influence from the residents of Westminster this will get pushed through one way or another and any high rise of that caliber will have a high impact of the values there. Construction will have an environmental impact. And a high rise being allowed will open the way for new and similar developments and negatively impact the community.

The area of Shore Drive surrounding Westminster is a close and intimate community. If residents here wanted high rise living we would be at the ocean front. In order to preserve living style diversity we need to reserve some beach front areas as quiet community living.

This area of the city must have more senior care facilities. Independent living as well as assisted living are a going to be a big growth factor in less than ten years. The current Westminster Canterbury buildings on Shore Drive have been good for the neighborhood for over thirty years. They haven proven time and time again that they do a lot of good for the community and local area. Let them expand and build additional building. They are the number one provider of a full service living home environment in America Which treats all seniors medical and living needs. Westminster Canterbury is a not for profit run base organization. They give back to their residents and local area non residents, senior medical care needed. If Westminster Canterbury does not make this investment to build a first class “state of the latest” building, then some other will build and it would be a real eye sore investor run failure of a senior center. I live and work here. While Westminster has good people there, I also think we must take into consideration the experience of the neighborhoods around it. The proposed construction is too big and I believe will have a negative impact on neighbors.

I live in Baylake Pines and have on and off since 1955. The high density housing that is going on everywhere along SD is ruining the ambience and qualities of life here. The destruction of view shed Thursday, Feb 13th at Lesner Bridge should serve as huge example. The city should reign in the exploration of this once very beautiful area.

I live on Starfish Road – so the traffic, parking and loss of the publicly owned beach access affect my quality of life greatly. The proposal is too big for the area – I have concerns about how this affects the Thursday, Feb 13th EMS services response times if they are tied up at WC like they were in December when there was a laundry room fire at WC (15+ EMS units on site).

WCCB – Westminster Canterbury by Chesapeake Bay- has been “working with the City for about a year” on redeveloping 16.88 acres in the bayfront.

Planning Commission is scheduled to have a public hearing and vote as soon as MARCH 11 ’20.

SDCC Route 35 NOV ’19 Survey Results

Our 2nd Survey about Route 35 started about a month after Route 35 ended in 2019.

  • There needs to be a stop on south side of Shore Drive beside Kroger’s. There are senior apartments and employees at Kroger’s who would use it if there were a bus stop.
  • There should be more stops on Shore Drive..one at the foot of the Lesner on each side for residents along Page Ave and in Ocean Park would make sense. I don’t want to DRIVE 2 miles to catch the bus.
  • Need more handicap services to get around oceanfront if I could go- once there- walking is tough
    E-scooters taking up space at bus stops. Do e-scooters pay for that space?
  • The schedule is not posted at the bus stop so I don’t know when or how often it comes. Or the exact route
  • Didn’t know when or where to get a return bus.
  • Not familiar with how often it runs and where it stops.
  • While waiting for a bus we can be there by car and come back exactly when we are ready. The bus doesn’t solve any problem for us.
  • I tried once, but it was very late. Never tried again
  • As I understand, you could wait for up to an hour, as it isn’t timed stops.

  • Still not sure whether the bus stops only at designated stops or if it will stop is hailed at any point on route. Wish this info were more publicized
  • Add a stop next to Kroger. There is a Special Needs young man that works there and a stop would allow him to take the bus to work. Add a stop at Kendall Street, now that the sidewalk is finished this stop would service the residents of Cape Henry Shores.
  • Have Kroger sell tickets. Allow 65+ to purchase 1/2 fare tickets on the app as well as the regular fare that’s there now.
  • Op.year round. First Landing/seashore park riders need to be at a pick up stop On shore drive as everyone else. Bus turning off into park area for riders waste time and resources. Never been on bus when any rider got on or off inside park. Will they pick me up at my front door? Overall, A GREAT RIDE!
    Run it all year on week ends after the summer ends.

  • I plan to use it more next year. Would love it to be year round.
  • have current bus location on an “app”. (most times we’ve used it, the bus arrived over half hour after the time we expected it. So frustrating to wait that long). We would use it much more frequently if we could avoid sending at the bus stop for about an hour each round trip.

  • 35 should operate year round. There are a lot of restaurants on this route and people who need to get to work year round. It is good having this bus as the 29 only runs once per hour.
  • I appreciate that my teenager can take it to get down to the ocean. The drivers allow him to take his surfboard. I really appreciate that they have this route.
  • Year round for the people that depend on it; although, I don’t use it often, it is an easy way to get around the beach!
